Mary is nationally recognized as a retirement plan expert, having worked with small and large companies in designing and administration of retirement programs.  Her practice includes all types of employee benefit plans, including executive compensation programs.  She serves as an adjunct professor at Hamline University School of Law teaching "Pensions and Employee Benefits."

ESOP Evaluation
Worked with a company that was assessing whether to establish an Employee Stock Ownership Plan or not. Evaluated the legal and financial impacts as well as the employee communication challenges.

401(k) Plan Design
Developed a new 401(k) plan package for a financial firm to offer to its clients. Wrote employee communication material as well as designed and delivered the training program for the staff.

401(k) Plan Error
Worked with a company to identify and correct plan administrative errors in the 401(k) plan. Established new procedures to avoid future errors.

Personal Trust
Provided an assessment of the competitive need, the legal requirements, and the internal systems requirement for a financial firm to implement a new personal trust offering.

Defined Benefit Plan
Assisted a multiple-employer plan to evaluate the impact of freezing the DB plan; worked with them to communicate the decision to the boards of directors and the employees; and then helped the different employers design alternative retirement plans for employees.

COBRA Subsidy Extended
The 65 percent federal subsidy of COBRA premiums for individuals who have been involuntarily terminated from employment has been extended both in length of the subsidy period and the eligibility period.

Roth IRA Conversion
In 2010, anyone with a traditional IRA, including a rollover IRA, will have the opportunity to convert that IRA into a Roth IRA regardless of income. Previously, only individuals with a modified gross income of greater than $100,000 were unable to do a Roth conversion. Effective in 2010, that restriction is removed and all individuals are able to convert an existing traditional IRA into a Roth IRA.

End of the Year Retirement Plan Issues
Every year there are some “housekeeping items” that need the attention of retirement plan sponsors and 2009 is no exception. However, this year there are some additional items beyond the standard participant communication notices that need to be addressed.

Defined Benefit Funding
The IRS has issued final regulations governing the funding requirements for single and multiple employer Defined Benefit plans that are effective for plan years beginning on or after January 1, 2010.

2010 Plan Limits
The IRS has issued the 2010 limits for various employee benefits. The retirement plan limits have not changed, although there are some changes for health plan benefit limits.
